These Terms of Service explain the conditions that apply when using the Elder Guardian 360™ website, purchasing products, scheduling consultations, enrolling in services, or communicating with us.

Effective Date: August 3, 2026

Important: Elder Guardian 360™ is not an emergency response service and does not provide 24-hour monitoring, emergency transportation, emergency medical assistance, or continuous supervision. For a medical or safety emergency, call 911.

Agreement to These Terms

These Terms of Service constitute an agreement between you and Elder Guardian 360™ LLC. “Elder Guardian 360,” “we,” “us,” and “our” refer to Elder Guardian 360™ LLC. “You,” “client,” and “user” refer to the person accessing the website, purchasing a product, requesting services, receiving services, or acting as an authorized representative.

By accessing this website, submitting a form, scheduling an appointment, purchasing a product or service, signing a service agreement, authorizing payment, or receiving services, you acknowledge that you have read, understood, and agreed to these Terms.

A person acting for another individual represents that they have sufficient authority to provide information, schedule services, communicate with Elder Guardian 360™, and make commitments on that person’s behalf.

1. Services Provided

Elder Guardian 360™ provides non-medical services that may include:

  • Senior advocacy
  • Care coordination and resource navigation
  • Appointment preparation and accompaniment
  • Authorized family communication
  • Hospital, rehabilitation, and discharge-transition support
  • Non-clinical wellness observations and scheduled check-ins
  • Senior Life & Family Coaching
  • Transition & Urgent Support
  • LifeFile organizational products and related materials
  • Document, information, and next-step organization

The specific services provided depend on availability, location, client needs, authorizations, the selected package, and any separate written service agreement.

2. Non-Medical Scope

Elder Guardian 360™ is not a hospital, medical practice, home health agency, nurse registry, emergency service, law firm, financial advisory firm, guardianship agency, or licensed healthcare provider.

We do not provide:

  • Medical diagnosis, treatment, or clinical advice
  • Nursing services or medication administration
  • Hands-on personal care
  • Bathing, dressing, toileting, lifting, or transferring
  • Wound care, injections, or vital-sign monitoring
  • Psychotherapy or mental-health treatment
  • Legal, tax, insurance, or financial advice
  • Guardianship or medical decision-making
  • Emergency response or continuous supervision

3. No Guarantee of Outcome

Elder Guardian 360™ provides education, organization, communication assistance, advocacy, coordination, and supportive guidance. We do not guarantee any specific medical, legal, financial, housing, placement, insurance, family, provider, or service outcome.

Recommendations and resource information are based on the information available at the time. Circumstances, provider availability, costs, insurance coverage, eligibility, and client needs may change.

The client and authorized decision-makers remain responsible for evaluating options and making final decisions.

4. Client and Family Responsibilities

Clients and authorized representatives agree to:

  • Provide accurate, current, and complete information
  • Disclose relevant changes in circumstances or safety concerns
  • Identify authorized family members and representatives
  • Provide requested consent and authorization documents
  • Maintain a reasonably safe environment for in-person services
  • Treat Elder Guardian 360™ personnel respectfully
  • Avoid requesting services outside our non-medical scope
  • Contact appropriate professionals for medical, legal, or financial advice
  • Call 911 when emergency assistance is needed

Elder Guardian 360™ may rely on information provided by the client, family, representatives, facilities, providers, or other third parties.

5. Authorization and Consent

Certain services may require written or verbal authorization before Elder Guardian 360™ may communicate with family members, healthcare providers, facilities, insurers, attorneys, service companies, or other parties.

Clients are responsible for identifying who may receive information and for promptly informing us when an authorization should be changed or withdrawn.

Withdrawal of authorization applies to future communication and does not invalidate actions already taken in reasonable reliance on the prior authorization.

6. Scheduling and Availability

Consultations, coaching sessions, visits, appointment support, and Transition & Urgent Support are subject to scheduling, location, authorization, travel requirements, and availability.

Same-day, after-hours, weekend, holiday, or immediate service is not guaranteed. Appointment times may need to be adjusted due to provider delays, facility restrictions, illness, weather, traffic, emergencies, or other circumstances beyond our control.

Clients should not delay contacting emergency services or licensed professionals while waiting for Elder Guardian 360™ availability.

7. Coaching Services

Senior Life & Family Coaching is an educational and supportive service focused on planning, decision support, caregiver concerns, family communication, aging transitions, and practical next steps.

Coaching is not psychotherapy, mental-health counseling, medical treatment, legal advice, financial advice, or emergency crisis intervention.

Session quantities, package periods, email support, expiration dates, scheduling requirements, and other package terms are those stated at checkout, on the applicable webpage, or in the related service agreement.

8. Transition & Urgent Support

Transition & Urgent Support provides scheduled, short-term, non-medical advocacy and care coordination during hospitalizations, rehabilitation stays, discharges, significant changes, or other time-sensitive care transitions.

This service does not include unlimited hours, overnight care, continuous supervision, on-call medical support, 24-hour availability, emergency transportation, or emergency response.

The 30-day service period, when purchased, begins and ends according to the applicable checkout terms or service agreement. Specific activities, communication schedules, and service limits may be documented in an individual service plan.

9. Monthly Plans and Recurring Payments

Certain advocacy plans may be offered on a recurring monthly basis. When you authorize a recurring payment, you authorize the applicable payment processor to charge the payment method on file at the frequency and amount disclosed during enrollment, unless the plan is cancelled according to the applicable cancellation terms.

Monthly services do not include unlimited time or unlimited availability unless expressly stated in a signed agreement. Services are limited to the activities, frequency, and scope identified in the selected plan or service agreement.

Changes to a plan, price, or service scope will be communicated before they apply to a future billing period when required.

10. Fees and Payment

Prices are disclosed on the website, payment page, invoice, proposal, or service agreement. Payment is due according to the terms presented for the selected product or service.

Hourly services may include minimum service periods, travel time, mileage, parking, admission charges, document fees, or other approved expenses when disclosed in advance or included in a service agreement.

You authorize Elder Guardian 360™ and its payment processor to charge the payment method provided for authorized purchases, invoices, recurring plans, and approved fees.

Unpaid or declined balances may result in delayed, suspended, or terminated services. The client remains responsible for valid charges and any lawful collection costs permitted by the applicable agreement and law.

11. Cancellations and Rescheduling

Appointment cancellation, rescheduling, missed-session, and no-show requirements are governed by the policy disclosed at scheduling, checkout, or in the applicable service agreement.

A late cancellation or missed appointment may result in loss of the session or a cancellation charge when that policy was disclosed before scheduling or purchase.

Monthly plans must be cancelled according to the written notice requirements in the applicable enrollment or service agreement. Cancellation generally stops future renewals but does not automatically refund services, time, products, or billing periods already provided or started.

12. Refunds and Credits

Except where required by law or expressly stated at checkout, all sales are final once a service period has begun, a session has been used, work has started, a digital product has been delivered, or a printed product has entered production or shipment.

Digital products and downloads are generally non-refundable after delivery or access. Printed and customized products may be non-refundable after printing, preparation, or shipment.

Promotional offers, assessment credits, package discounts, and other credits are subject to the conditions and expiration terms stated when offered. Credits have no cash value unless required by law.

Any approved refund will ordinarily be returned to the original payment method and may take additional time to appear depending on the payment provider or financial institution.

13. Products and LifeFile Materials

LifeFile and related materials are organizational and informational resources. They are not official medical records, medical-alert systems, emergency-response systems, legal documents, or substitutes for professional advice.

Users are responsible for entering accurate information, reviewing it regularly, storing it securely, and sharing it only with trusted and authorized individuals.

Product descriptions, formats, page counts, packaging, and design details may be updated without materially changing the product’s intended organizational purpose.

14. Third-Party Providers and Resources

Elder Guardian 360™ may provide information about healthcare providers, facilities, home-care companies, transportation services, attorneys, financial professionals, community resources, government programs, contractors, or other third parties.

Unless expressly stated in writing, providing a name or resource does not constitute a warranty, endorsement, guarantee, employment relationship, partnership, or control over that third party.

Clients are responsible for independently evaluating third-party qualifications, licensing, availability, pricing, insurance, contracts, and suitability.

Elder Guardian 360™ is not responsible for the acts, omissions, availability, pricing, policies, or performance of independent third parties.

15. Privacy and Confidentiality

Personal information is handled according to our Privacy Policy, applicable authorizations, operational requirements, and legal obligations.

Elder Guardian 360™ may maintain non-clinical service notes, appointment information, wellness observations, authorization records, family communications, payment records, and documents supplied by clients or authorized representatives.

We do not create or maintain official clinical medical records. Healthcare providers and facilities remain responsible for their own clinical records.

Clients should avoid sending highly sensitive information through general website forms, standard email, or social-media messaging unless directed to an appropriate method.

16. Electronic Communications

By providing an email address or telephone number, you consent to receive service-related communications through email, telephone, text message, scheduling platforms, payment platforms, or other reasonable electronic methods.

Electronic communications may include appointment confirmations, invoices, receipts, intake information, scheduling links, service updates, administrative notices, and requested resources.

Standard message and data rates may apply. You are responsible for maintaining accurate contact information and protecting access to your devices and accounts.

Electronic acceptance, payment authorization, check-box consent, and electronic signatures may be treated as evidence of your agreement to the applicable documents and transactions.

17. Website Use

You agree not to misuse the website, interfere with its operation, attempt unauthorized access, introduce malicious code, impersonate another person, submit false information, or use website content for unlawful purposes.

Website information is provided for general informational purposes and may not reflect every individual circumstance. Website content does not create a professional medical, legal, financial, or fiduciary relationship.

We may modify, suspend, restrict, or discontinue website features without prior notice when reasonably necessary.

18. Intellectual Property

The Elder Guardian 360™ name, branding, website content, written materials, graphics, service descriptions, LifeFile designs, forms, worksheets, and original resources are owned by or licensed to Elder Guardian 360™ LLC unless otherwise stated.

Purchasers may use materials for their own personal or authorized family use. Materials may not be copied, resold, republished, distributed, modified for commercial use, or represented as another person’s work without written permission.

19. Suspension or Termination

Elder Guardian 360™ may decline, suspend, or terminate services when reasonably necessary, including when:

  • Requested services fall outside our scope
  • Payment obligations are not met
  • Required information or authorization is unavailable
  • The environment is unsafe
  • There is abusive, threatening, discriminatory, or unlawful conduct
  • The client requires a higher level of care than we can provide
  • Continuing services would violate law, ethics, policy, or professional boundaries

When reasonably possible, we will communicate the termination and provide information about appropriate alternative resources.

20. Emergencies and Safety

Elder Guardian 360™ is not a substitute for 911, emergency medical services, law enforcement, crisis hotlines, adult protective services, or licensed clinical providers.

When we reasonably believe there is an immediate threat to health or safety, we may contact emergency services, law enforcement, protective services, an authorized representative, or another appropriate party.

Do not use website forms, email, voicemail, social media, or online scheduling to report a medical or safety emergency.

21. Limitation of Liability

To the fullest extent permitted by applicable law, Elder Guardian 360™ LLC and its owners, employees, contractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to the website, products, services, delays, third-party providers, client decisions, or information supplied by others.

To the fullest extent permitted by law, any direct liability arising from a particular paid service or product will not exceed the amount actually paid to Elder Guardian 360™ for the specific service or product giving rise to the claim during the applicable service period.

These limitations do not exclude liability that cannot lawfully be limited or excluded.

22. Client Responsibility for Claims

To the fullest extent permitted by law, you agree to be responsible for losses, claims, or expenses arising from:

  • Information you knowingly provide that is false or materially incomplete
  • Your unauthorized disclosure of another person’s information
  • Your misuse of the website, products, or materials
  • Your violation of these Terms or applicable law
  • Instructions given by a person who lacked authority to act

This provision does not require you to assume responsibility for conduct caused solely by Elder Guardian 360™ where such responsibility cannot lawfully be transferred.

23. Events Beyond Reasonable Control

Elder Guardian 360™ is not responsible for delays or inability to perform caused by events beyond reasonable control, including severe weather, hurricanes, flooding, power failures, internet or telecommunications outages, illness, transportation disruptions, facility restrictions, government orders, labor shortages, emergencies, or failures of third-party systems.

When possible, affected services will be rescheduled, modified, credited, or addressed according to the circumstances and the applicable service agreement.

24. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Before filing a formal claim, the parties agree to make a good-faith effort to resolve the concern through written notice and direct discussion.

Unless applicable law requires otherwise, any legal proceeding arising from these Terms or Elder Guardian 360™ services shall be brought in a court with proper jurisdiction located in or serving Pinellas County, Florida.

25. Changes to These Terms

Elder Guardian 360™ may revise these Terms to reflect changes in services, pricing practices, technology, business operations, or legal requirements.

Updated Terms will be posted on this page with a revised effective date. Material changes affecting an active written service agreement will be handled according to that agreement and applicable law.

Continued use of the website or purchase of new services after an update constitutes acknowledgment of the revised Terms.

26. Severability and Waiver

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

A failure by Elder Guardian 360™ to enforce a provision on one occasion does not waive the right to enforce that provision later.

Section headings are provided for convenience and do not limit the meaning of the provisions.

27. Entire Agreement and Acceptance

These Terms, together with the Privacy Policy, applicable checkout terms, invoices, authorizations, product descriptions, and signed service agreements, constitute the agreement governing the applicable transaction or service.

By accessing the website, submitting information, signing an agreement, authorizing payment, purchasing a product, enrolling in a plan, scheduling a session, or receiving services, you confirm that you have had an opportunity to review and understand the applicable terms.

Nothing in these Terms limits rights or remedies that cannot lawfully be waived under applicable law.

Which Terms Apply When Documents Differ?

A signed individual service agreement may contain additional or more specific terms concerning scope, scheduling, fees, communication, cancellation, and service limits.

When a signed service agreement directly conflicts with these general website Terms, the signed agreement controls for that specific service and client. Checkout terms and product descriptions control details specific to the purchased package or product unless a signed agreement states otherwise.

The Privacy Policy governs the collection and handling of personal information.
